Supercue1. Acceptance of Terms
By downloading, installing, or using the Supercue application ("App") or any related services (collectively, the "Service") provided by NEW HORIZON SOFTWARE LTD ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Supercue is an AI-powered real-time call coaching application for iPhone. It listens to your phone calls and provides live cues, talking points, and objection handlers to assist you during conversations. The Service is intended for professional use in sales, customer service, and similar contexts.
3. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To access certain features, you may need to create an account. You agree to provide accurate, complete, and current information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.
5. Subscriptions & Payments
Supercue may offer subscription plans with recurring fees. All purchases are processed through Apple's App Store and governed by Apple's payment terms. Subscription fees are non-refundable except as required by applicable law or Apple's refund policy. We reserve the right to change pricing with reasonable notice.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Record or monitor calls without the legally required consent of all parties (compliance with wiretapping and eavesdropping laws is solely your responsibility)
- Reverse engineer, decompile, or disassemble the App
- Use the Service to harass, defraud, or harm others
- Attempt to gain unauthorised access to our systems
- Resell or sublicense the Service without our written consent
- Use automated tools to scrape or extract data from the Service
7. Call Recording & Legal Compliance
You are solely responsible for ensuring your use of Supercue complies with all applicable laws regarding call monitoring, recording, and consent in your jurisdiction. Laws vary significantly by country and region. We do not provide legal advice, and nothing in these Terms constitutes legal advice. If in doubt, consult a qualified attorney before use.
8. Intellectual Property
The Service and all content, features, and functionality (including software, text, graphics, logos, and AI models) are owned by the Company or its licensors and are protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use it as described herein.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED COACHING CUES ARE SUGGESTIONS ONLY AND MAY NOT BE SUITABLE FOR ALL SITUATIONS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including Sections 8, 10, 11, and 12.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England and Wales.
